"Section 37/41 and tribunals need to be looked at seriously"

About: Forensic and Rehabilitation / Forest Close: Intensive Rehabilitation Services

(as a service user),

I was recalled on a section 37/41 in late 2015. At my tribunal told to finish my psychological . Funders would not pay for a secure hospital so I was sent to forest close rehabilitation Unit ti do more psychology.

22 months in Hospital when an acute unit originally said 2 weeks  i was fit to leave. 

My section 37/41 delayed my release by nearly 2 years. I feel that psychiatrists should make the decision only if you need treatment- one tribunal a year keeps hundreds of patients in Hospital- when they are not psychotic or a danger to anyone.

my tribunal was delayed at Forest Close over a year because I was wanting to be appropriately housed and my doctor wanted me to have overnights delaying my rehabilitation back into the community my months. Section 37/41 and tribunals need to be looked at seriously and thoroughly.

Hi Nashiraw87,

I am sorry to hear you were unhappy with your length of stay at Forest Close and the implications of your section; I appreciate that this will have caused some frustration.

As you may be aware a Section 37/41 is a court order. This can only be enforced and amended by the Ministry of Justice (MOJ). In effect your Responsible Medical Officer or (RMO) has to apply to the MOJ for all leave and any movement or changes in your care. At this particular time we are informed that the MOJ were experiencing a problem with resources and had been experiencing some change. All this has impacted on the length of time taken to approve any application for leave. I hope this explains the delay but if there are any other issues you wish to raise about your care please do not hesitate to contact the Trust. We are aware that the delays are causing considerable frustration with Service users and with your permission we will pass on your complaint.
