"Duty of Care, or lack there of for person with..."

I am utterly digusted and shocked by they way in which a hospital is allowed to treat and care for a person with special needs, I can appreciate that most hospitals in the local and wider area are struggling for staff to provide the care that is required, I can also appreciate that rooms are highly sort after and are in high demand, however that should neither effect or compromise a persons care. A family member with special needs has recently undergone operation to help repair a large hernia, but an operation which in normal circumstances would be low risk has now transformed into a situation whereby they are in a critical care ward due to the lack of duty of care and basic practice - we understand as a family like all others that we aren't a high priority or even a speciliast case, but what amazes me is that the following misshaps/incompetence can occur during a simple proceedure: incorrect ratio of oxygen via the air lines when brought around has now left my sibling with high levels of carbon dioxide in his body, staff were unaware of him being MRSA positive and hardly used the alcohol hand wash which as available, he has since been moved to an open wars with elderly people on in which this can be passed on (now endangering other people's lives and putting them at risk). Where does due dilligence and common sense prevail in all of this, it's the basic form of care and consideration for any individual. We now have to contend with a distressed family member who doesn't understand or have the comprehension to understand what is happening or what's being done to support him and his needs.
