"I feel I am being constructively denied my right to medical care"

About: Neurosciences (DCN) / Neurology Royal Infirmary of Edinburgh at Little France

(as a service user),

I was scheduled for clinic appointment with a consultant neurosurgeon at the Department of Clinical Neurosciences (DCN), Royal Infirmary Edinburgh (RIE). One of my family member assisted me to arrive for the appointment. When we arrived at the DCN RIE, for the appointment, we were told my appointment has already been cancelled and without prior notice. This was shocking, extremely distressing and added to my ongoing agony. I feel this is against patient rights. We asked reason for the cancellation. We were told the consultant with whom my appointment was scheduled does not work on that day of the week.

On the same day, I complained to the local health board and requested an urgent clinic appointment with another consultant neurosurgeon at Western General Hospital Edinburgh instead. Two senior members of patient experience team instead sent me details of the litigation team which I did not ask for, but they did not arrange an urgent appointment. The complaint was required to be concluded within 20 working days, but it was not.   I sought FOI report to try to ascertain the truth about the cancellation. FOI report confirms, that the consultant had reviewed several other patients in an outpatient clinic. Therefore in my opinion proving that the reason given for the cancellation of my appointment was not true.

The last year also, I had genuine reasons to complain about another staff member at the RIE, but as a consequence I was discharged from neurological clinic without prescription and treatment. This resulted in me having to go abroad for my care and treatment which not only was distressing, inconvenient but I had to spend huge sums of money for that. I believe there are grudges by DCN, RIE.  The cancelled appointment was scheduled because a hospital consultant sent two referrals to neurosurgery after clinic examination. Two MRI both have significant findings like Nerves compression and Blocked vertebrae etc. And discharge by physiotherapist for care and treatment by neurosurgery as physiotherapist intervention did not help me and my symptoms are worsening with every passing day.  

In these circumstances my request for urgent clinic appointment with another consultant neurosurgeon at Western General Hospital Edinburgh I believe is justified, as in these circumstances I can no longer trust in the DCN, RIE. I feel am being constructively denied my right to medical care being a member of ethnic minority and that I am being victimised because of my previous genuine complaints against NHS Lothian.

In another instance, I feel there is medical coercion. They desire me to accept ear surgery where I believe from what I have read that the failure rate is high. A treatment which Consultant ENT Surgeon suggested me after over 11 years from previous failed surgery. For over 11 years ENT did not admit failure of previous surgery. This ear treatment is possible in England, but I am being denied this too.

Am I a tester? Am I not a human being, so what if I am from ethnic minorities?

Be re-assured you have an appointment booked in early January 2022.

Appointment of January 2022 is far too delayed.

The ENT did not respond to this story. I at my own arranged audiology review because I have started experiencing tinnitus in my right ear as well. I believe referral by NHS Lothian to some experienced ENT Professor at Ear Institute London, NHS England is essential given the history and complications I am experiencing. Silence or brushing this matter under carpets will only add to problems.
