"Failure to comply with NHS Constitution"

About: Leicester General Hospital / Trauma and orthopaedics

The NHS Constitution is clear and specific. It states that you will receive treatment for a non-urgent condition within 18 weeks of diagnosis.

I have a diagnosis for shoulder impingement in writing from February of last year from University Hospitals Leicester. The General Hospital to be specific.

When I was seen in February of last year I didn't even have a physical examination but I would confirm the diagnosis as being correct. I have been told that I can expect an ultrascan within six months, 18 months after my initial diagnosis, which still doesn't represent treatment.

It would be simpler, and more honest for UHL Leicester to state that they don't adhere to the NHS Constitution and that they don't handle non-emergency conditions.

I have been trying to make the parliamentary and Health Ombudsman read the NHS Constitution and have now contacted my MP.

I'm quite concerned to hear about the points you raise. It's very difficult to respond as I do not have details of your case and an understanding of what correspondence has taken place between your GP and our consultant.

Your note doesn't say whether you have made a complaint to us or whether you have sought support from out PILS team to get an answer.

Yes, of course, I took the complaint up originally with UHL Leicester. I have added a follow up to this post which shows how things are progressing and are actually getting worse. I would add that I have a much more serious health problem that is going to catch up with me very shortly, and I hope to get in to see my GP tomorrow.

I received this SMS message last week - I quote "Reminder: You will receive a telephone appointment on Thursday 17th January 2013 at 11.40. please ring XXXX XXXXXXX if you are not able to receive this."

This appears to be a prank as I cannot receive a reminder for something that I have yet to be informed about, by logical deduction. I don't know what a telephone appointment is anyway, and assigning a time and date without a location is merely adding layers of confusion to what should be a simple process. Is this really a time and date being assigned to the process of issuing and appointment - thus an appointment for an appointment.

I honestly don't know. Thankfully my intellect is not diminished but anyone elderly would be utterly baffled by such incomprehensible messages.

I will submit a formal complaint on this issue as I resent anyone misusing my phone. That the hospital should do it is utterly appalling.

I have retained the SMS on my phone as evidence.
