"Local Commissioners refuse to refer me to hospital of choice."

Four years ago I decided to pay privately from my savings for surgery as my treatment via my GP did not solve my problems. This saved the NHS a considerable amount of money. I now have a recurrence and want to see the same consultant in whom I trust. I asked my GP to refer me - and was refused as I live in Slough and the hospital I want to go to is in London. I was told the local commissioners would not pay for a London hospital. When I said I thought I had a legal right to ask for any hospital of my choice I was told that I may have a legal right but the commissioners will still not refer me and pay for this - even if I took them to court. I would just mention that my local hospital has failed recent inspections and is being put into special measures - and I do not want to be referred to this hospital and a totally new consultant (who I would no doubt never see) - I want to see the consultant surgeon who knows me and who performed the initial operation. My savings are not unlimited and I do not see why I should again have to pay privately for this when I have a legal right to ask to be seen at any hospital of my choice.
